Job Overview
Our client specializes in the representation of clients in the commercial and residential mortgage industry. Our areas of focus include foreclosure, bridge lending, mortgage acquisition and sale (performing and non-performing mortgages), commercial real estate transactions, and loan workouts.
The attorneys and paralegals at our clients have extensive experience, including participation in well over twenty-five thousand foreclosure matters, thousands of bridge lending transactions, and countless purchase and sale transactions involving mortgages and real property. We do not focus on cookie-cutter solutions or unnecessary litigation. Our focus is achieving the best possible result for our clients through strategic, practical, and effective legal solutions.
We are a fast-growing law firm focused on real estate, mortgage, and complex litigation matters. We are seeking an experienced Litigation Attorney with approximately 10 years of legal experience, preferably with a strong background in lender default services, foreclosure, commercial litigation, and/or real estate litigation.
The ideal candidate will have substantial experience independently managing a litigation caseload from inception through resolution, appearing in court, developing litigation strategy, drafting and arguing motions, and communicating directly with clients and opposing counsel.
Responsibilities
Independently manage a substantial caseload from inception through conclusion, including complex and contested matters
Develop and implement litigation strategies designed to achieve favourable outcomes for clients
Draft, review, and finalize pleadings, motions, briefs, affidavits, discovery demands and responses, and other legal documents for court submission
Conduct legal research and apply relevant law and procedural rules to complex litigation matters
Appear regularly in New York State courts, including New York Supreme Court, for conferences, motions, hearings, and other proceedings
Prepare for and participate in depositions, discovery proceedings, settlement negotiations, and other litigation-related matters
Communicate effectively with clients, opposing counsel, court personnel, and other parties
Analyse cases, identify potential legal and factual issues, and provide practical recommendations to clients
Review and oversee work product to ensure accuracy, compliance, and adherence to applicable court rules and deadlines
Collaborate with attorneys, paralegals, and firm staff to efficiently manage matters and meet client objectives
Assist with mentoring and providing guidance to junior attorneys and legal staff as appropriate
Qualifications & Skills
Approximately 10 years of litigation experience, preferably involving foreclosure, mortgage default services, real estate, commercial litigation, or related matters
Admission to the New York State Bar and in good standing
Substantial experience handling cases independently from inception through resolution
Strong knowledge of New York Supreme Court procedures, rules, and filing requirements
Demonstrated experience drafting and arguing motions and other litigation papers
Strong legal research, analytical, writing, and oral advocacy skills
Experience with compliance requirements applicable to mortgage and lender default litigation
Excellent written and verbal communication skills
Strong organizational skills and the ability to manage multiple matters, deadlines, and competing priorities
Exceptional attention to detail and commitment to producing high-quality work
Ability to exercise sound judgment, work independently, and develop practical litigation strategies
Strong client-management and interpersonal skills
